City of Lowell Law Department 375 Merrimack Street, 3rd Floor Lowell, MA 01852 Dear Attorney Moeser: I have received the petition of Caitlyn Russell appealing the nonresponse of the City of Lowell (City) to her request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Russell requested several records relating to an incident that occurred in December of 2020. Claiming to not yet have received a response, Ms. Russell petitioned this office and this appeal was opened as a result. Subsequently, I learned that the City responded to Ms. Russell’s request with a response sent on June 21, 2021. Where the basis of this appeal was opened as a result of the City’s lack of a written response, I will now consider this administrative appeal closed. Ms. Russell may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
