Murray Supervisor of Records June 23, 2021 SPR21/1458 Priya Tahiliani Superintendent Everett Public Schools 121 Vine Street Everett, MA 02149 Dear Ms. Tahiliani: I have received the petition of Steven Fitzgerald appealing the response of the Everett Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 13, 2021, Mr. Fitzgerald requested, “… [a] copy of all emails and texts messages sent and received from Everett School Committee Chairman … to each member of the Everett School Committee and the Administration of the Everett School Department on April 5, 2021.” Previous appeal This request was the subject of a previous appeal. See SPR21/0998 Determination of the Supervisor of Records (April 23, 2021). In my April 23rd determination, I found that the School established good cause to permit an extension of 30 business days to furnish copies of records responsive to Mr. Fitzgerald’s request. Claiming to not yet have received responsive records, Mr. Fitzgerald petitioned this office and SPR21/1458, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the School has provided a response. As such, the School is ordered to provide Mr. Fitzgerald with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Fitzgerald may appeal the substantive nature of the School’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
