The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records June 21, 2021 SPR21/1459 Ms. Diane Riley Medford Police Department 100 Main Street Medford, MA 02155 Dear Ms. Riley: I have received the petition of Joseph Viglione appealing the nonresponse of the Medford Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Viglione requested records of “[a]ny police report or Internal Affairs Investigation document or documents on an alleged physical assault by a police captain on a patrol officer.” Claiming to not yet have received a response, Mr. Viglione petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department responded to Mr. Viglione’s request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Viglione may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
