Murphy, Lamere & Murphy, P.C. 50 Braintree Hill Office Park, Suite 202 Braintree, MA 02184-8807 Dear Attorney Sumners: I have received the petition of Lisa Morales appealing the response of the Town of Onset Fire District (District) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Ms. Morales requested: 1. Salary including overtime of the 10 highest paid District job titles for year ending December 31, 2020; 2. Current Health, Dental and Life Insurance information including number of covered persons in each category ie. Single/family active, single/family retiree, sing/family Prudential Committee and Water Commissioners; total cost of each plan; District cost of each plan, and 3. Total salary paid to [an identified person] for 2020 in all positions. The District provided a May 10, 2021 response which included a fee estimate to provide Ms. Morales with responsive records. Unsatisfied with the response and asserting that the District is withholding records, Ms. Morales petitioned the Supervisor of Records (Supervisor), and this appeal was opened. On June 23, 2021, in response to the opening of this appeal, the District provided a subsequent response indicating that it is not withholding records, the District provided a fee estimate and is awaiting Ms. Morales’ payment of the fee. Where the basis of this appeal was opened as a result of the District’s May 10th response, I will now consider this administrative appeal closed. Ms. Morales may appeal the substantive nature of the District’s June 23rd response within ninety calendar days. See 950 C.M.R. 32.08(1).
