Murray Supervisor of Records June 30, 2021 SPR21/1548 Kate Roy Director of Communications & External Affairs Massachusetts Municipal Wholesale Electrical Company 327 Moody Street Ludlow, MA 01056 Dear Ms. Roy: I have received the petition of Patrick Courtney of the Foundation for Fair Contracting of Massachusetts appealing the response of the Massachusetts Municipal Wholesale Electrical Company (MMWEC) to a request for public records. G. L. c. 66, § l0A; see also 950 C.M.R. 32.08(1). On May 20, 2021, Mr. Courtney requested copies of the following records: “… Project 2015A advertisements[,] Bids for Project 2015A[,] RFP for Project 2015A[,] Prevailing Wage schedule for Project 2015A.” On June 9, 2021, Mr. Courtney modified his request as follows: “… 1. Any memo or correspondence that discusses the prevailing wage option that you told [identified person] … 2. A brief spec summary that gives an overview of what would be expected of a contractor.” MMWEC responded on June 11, 2021. Unsatisfied with the response, Mr. Courtney appealed and SPR21/1548 was opened as a result. Subsequently, I learned that MMWEC provided a supplemental response on June 30, 2021. Where the basis of this appeal was opened as a result of the of MMWEC’s June 11th response, I will now consider this administrative appeal closed. Mr. Courtney may appeal the substantive nature of MMWEC’s June 30th response within 90 days. See 950 C.M.R. 32.08(1).
