Murray Supervisor of Records July 2, 2021 SPR21/1552 Debra Fagerstrom Town Clerk Town of Brimfield 23 Main Street Brimfield, MA 01010 Dear Ms. Fagerstrom: I have received the petition of Noah Bombard of MassLive appealing the response of the Town of Brimfield (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 23, 2021, Mr. Bombard requested in pertinent part the following records: copies of emails from or to town accounts that met several search terms as well as police incident reports filed during specific time frames. The Town responded on March 29, 2021 and produced the police incident reports but did not produced the requested emails. Unsatisfied with the Town’s response, Mr. Bombard appealed and SPR21/1552 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Mr. Bombard. Accordingly, the Town is ordered to provide Mr. Bombard with a response to the request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Bombard may appeal the substantive nature of the Town's response within ninety days.
