Staff Attorney City of Lowell 375 Merrimack Street Lowell, MA 01852 Dear Attorney Hucksam: I have received the petition of Arthur Grenier appealing the response of the City of Lowell (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 4, 2021, Mr. Grenier requested: “… Milestone X Protect Smart client…Any invoices, subscriptions and/or communication in written and/or electronic form since 1/1/2017.” Claiming to not yet have received a response, Mr. Grenier petitioned this office and this appeal SPR21/1578 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Grenier. Accordingly, the City is ordered to provide Mr. Grenier with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Grenier may appeal the substantive nature of the City's response within ninety days.
