Murray Supervisor of Records July 6, 2021 SPR21/1595 Michele Benjamin City Clerk City of Pittsfield 70 Allen Street Pittsfield MA 01201 Dear Ms. Benjamin: I have received the petition of Michael Maudin appealing the nonresponse of the City of Pittsfield (City) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 11, 2021, Mr. Maudin requested, “[a]ny and all e-mails, notes, memoranda, exhibits, records, and any and all other supplementary materials written by any employee or official of the City of Pittsfield, or by any employee or official of V-COMM Telecommunications Engineering Firm, concerning the testing of microwave radiation emissions from the Verizon Wireless Cellular Tower located at [named address] in Pittsfield …” Claiming to not yet have received a response, Mr. Maudin petitioned this office and SPR21/1595 was opened as a result. Subsequently, I learned that a response was provided to Mr. Maudin on June 28, 2021. Whereas this matter was opened based upon the City’s lack of a written response, I will now consider this administrative appeal closed. Mr. Maudin may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
