First Assistant City Solicitor City of Lowell 375 Merrimack Street Lowell, MA 01852 Dear Attorney Jenness: I have received the petition of Allegra Fieldsend appealing the response of the City of Lowell (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 10, 2021, Mrs. Fieldsend requested the following records regarding a City job posting: 1. Copy of the job posting 2. Copies of all webpages, emails, and any other means through which this position was advertised or announced 3. Copies of all documents evidencing any other outreach regarding this position 4. Complete copies of all applications received, including but not limited to received application forms and resumes 5. All documents, including but not limited to notes and reports, regarding the interview of the selected applicant 6. Copy of the employment contract for the selected applicant. On June 24, 2021, the City responded. Unsatisfied with the City’s response, Ms. Fieldsend appealed and SPR21/1638 was opened as a result. Subsequently, I learned that the City responded to Mrs. Fieldsend’s request with a further response sent on July 7, 2021. Where the basis of this appeal was opened as a result of the City’s July 1st response, I will now consider this administrative appeal closed. Mrs. Fieldsend may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
