G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 11, 2021, Mr. Maudin requested, “[a]ny and all e-mails, notes, memoranda, exhibits, records, and any and all other supplementary materials written by any employee or official of the City of Pittsfield, or by any employee or official of V-COMM Telecommunications Engineering Firm, concerning the testing of microwave radiation emissions from the Verizon Wireless Cellular Tower located at [named address] in Pittsfield…” Prior Appeal This appeal was subject to a prior determination. See SPR 21/1595 Determination of the Supervisor of Records (July 6, 2021). In my July 6th determination, I found that the City provided a supplemental response. Unsatisfied the City’s response, Mr. Maudin petitioned this office and SPR21/1674 was opened as a result. Subsequently, I learned that the City responded to Mr. Maudin with a further response sent on July 14, 2021. Where the basis of this appeal was opened as a result of the City’s July 6th response. I will now consider this administrative appeal closed. Mr. Maudin may appeal the substantive nature of the City’s response within ninety days. See 950 C.M.R. 32.08(1).
