Murray Supervisor of Records July 26, 2021 SPR21/1715 Cara Dahill Town Clerk Town of Carver 108 Main Street Carver, MA 01773 Dear Ms. Dahill: I have received the petition of Dorothy Vicino appealing the response of the Town of Carver (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Ms. Vicino requested any emails and meeting minutes that pertain to Ms. Vicino and her position from January 2019 to present. The Town provided a response on April 30, 2021. Unsatisfied with the Town’s response, Ms. Vicino petitioned this office and this appeal, SPR21/1715, was opened as a result. Pending Administrative Matter 950 C.M.R. 32.08(2)(b) provides in pertinent part: the Supervisor may deny an appeal for, among other reasons if, in the opinion of the Supervisor: 1. the public records in question are the subjects of disputes in active litigation, administrative hearings or mediation. The Town provided a response to this office on July 22, 2021 verifying a pending matter with the Commission Against Discrimination (MCAD) relating to the subject of Ms. Vicino’s request. See Vicino v. Town of Carver, et al. (MCAD Docket No. 19NEM02884). Conclusion In light of the pending administrative matter, I decline to opine on this matter. See 950 CMR 32.08(2)(b).
