Galvin, Town Clerk Town of Milton 525 Canton Avenue Milton, MA 02186 Dear Ms. Galvin: I have received the petition of Philip Johenning appealing the response of the Town of Milton (Town) to a request for public records. G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On June 22, 2021, Mr. Johenning requested, “[n]ames of individuals who volunteered for positions on the Warrant Committee for fiscal years 2019, 2020 and 2021[;] Names of individuals selected for the available positions[;] Qualifications of individuals selected and not selected to serve on the Warrant Committee [and] [a]ny written communications between those individuals who volunteered and the Town Moderator.” The Town provided a response on July 6, 2021. Unsatisfied with the Town’s response, Mr. Johenning petitioned this office and this appeal, SPR21/1775, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Mr. Johenning. Accordingly, the Town is ordered to provide Mr. Johenning with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Johenning may appeal the substantive nature of the Town's response within ninety days.
