Kirchner: I have received the petition of Keisha Edwards appealing the response of the Burlington Police Department (Department) to a request for public records. G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On June 3, 2021, Ms. Edwards requested the following records: (1) Any and all radio transmissions relative to [Named Case] (2) Any and all written documents, police reports, electronic email and memorandums from April 14, 2021 through June 3, 2021 relative to [Named Case] (3) Any and all text message correspondence from April 14, 2021 through date of compliance relative to [Named Case] of [Named Persons] (4) All telephone logs of [Named Persons] from April 14, 2021 and April 15, 2021. (5) Personnel and Internal Affairs files of officers [Named Persons] to include complaints, investigations and findings. (6) All numerical/statistical data that can be extracted from the Town of Burlington and/or their Police Department regarding the number of citizens' complaints lodged against employees of the Burlington, MA. Police Department from person/s whom identify as a minority for the last 5 years. (7) All numerical/statistical data that can be extracted from the Town of Burlington and/or their Police Department regarding the number of Citizens' Complaints lodged against employees of the Burlington Police Department and the number of Citizens' Complaints that have been classified as SUSTAINED for the last 5 years. (8) Any and all telephone recordings relative to [Named Case] (9) A copy of the Burlington MA. Police Department's policies relative to Citizens' Complaints. (l0)A copy of the Burlington MA. Police Department's policies/trainings on detaining/seizing individuals. Unsatisfied with the Department’s response, Ms. Edwards petitioned this office and this appeal, SPR21/1820, was opened as a result. Based upon a conversation between a Public Records Division staff member and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Ms. Edwards. Accordingly, the Department is ordered to provide Ms. Edwards with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Edwards may appeal the substantive nature of the Department’s response within ninety days.
