General Counsel Committee for Public Counsel Services – Audit and Oversight One Congress Street, Suite 102 Boston, MA 02114 Dear Attorney Hewitt: I have received the petition of Alfredo Companioni appealing the response of the Committee for Public Counsel Services (CPCS) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In 2020, Mr. Companioni requested any records maintained by the CPCS regarding an identified attorney. Previous appeal This request was the subject of a previous appeal. See SPR21/0282 Determination of the Supervisor of Records (February 19, 2021). In my February 19th determination, I stated that this office does not have jurisdiction over records maintained by the judicial branch of government. See G. L. c. 66, § 1. CPCS responded on July 2, 2021 stating that “… [CPCS does] not disclose personnel records.” Unsatisfied with the response, Mr. Companioni appealed and SPR21/1843 was opened as a result. As I indicated in my February 19th determination: please be advised that CPCS falls within the administrative auspices of the Supreme Judicial Court (Court). See G. L. c. 211D, § 1. Accordingly, the records you seek are considered judicial records and as such are not subject to the requirements of the Public Records Law. This office does not have jurisdiction over records maintained by the judicial branch of government. See G. L. c. 66, § 1. Accordingly, this administrative appeal is closed.
