The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records August 6, 2021 SPR21/1894 Ms. Helene Bettencourt Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148-4906 Dear Ms. Bettencourt: I have received the petition of Mr. Michael DiPronio appealing the nonresponse of the Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. DiPronio requested “copies of the latest Special Education Program Plan Statements” from a number of school districts. Having received no response, he petitioned this office. Subsequently, this office was notified that a response was provided, dated August 6, 2021. Where this matter was opened based upon the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. DiPronio may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
