Ryan Fortier City of Malden Police Department Administration and Operations Division 800 Eastern Avenue Malden, MA 02148 Dear Lt. Fortier: I have received the petition of Todd Wallack of WBUR appealing the nonresponse of the City of Malden Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 12, 2021, Mr. Wallack requested documents “showing the names of sworn officers within the Department who were terminated for misconduct, agreed to resign or retire to resolve misconduct accusations, or resigned, or retired with a pending internal affairs investigation since January 1, 2010.” Claiming to not yet have received responsive records, Mr. Wallack petitioned this office and this appeal, SPR21/1941, was opened as a result. It is my understanding the Department provided a response dated August 9, 2021 to Mr. Wallack’s request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will consider this administrative appeal closed.
