Assistant City Solicitor City of Worcester Law Department 455 Main Street, Room 301 Worcester, MA 01608 Dear Attorney Thompson: I have received the petition of Todd Wallack of WBUR appealing the nonresponse of the City of Worcester Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 12, 2021, Mr. Wallack requested documents “showing the names of sworn officers within the Department who were terminated for misconduct, agreed to resign or retire to resolve misconduct allegations, or resigned, or retired with a pending internal affairs investigation since January 1, 2010.” Claiming to not yet have received responsive records, Mr. Wallack petitioned this office and this appeal, SPR21/1943, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Mr. Wallack with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
