Panettiere, Esq. of Sandulli Grace, PC, appealing the response of the Town of Brookline (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 6, 2021, Attorney Panettiere requested the following: 1. All emails and text messages to and from the following individuals, as well as any relevant documentation from the following individuals, as it relates to [Named Person’s] injury that occurred on 1/14/21. 2. List of names of all fire department employees who were on injury status since The Town of Brookline stated using [Named Vendor] as 3rd party insurance vendor. 3. Any contract, agreement, and/or policy between the Town of Brookline and [Named Vendor]. On May 19, 2021, the Town responded. Unsatisfied with the Town’s response, Attorney Panettiere petitioned this office and this appeal, SPR21/1986, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Attorney Panettiere. Accordingly, the Town is ordered to provide Attorney Panettiere with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Panettiere may appeal the substantive nature of the Town's response within ninety days.
