Jansen appealing the response of the Grafton Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 29, 2021, Attorney Jansen requested numerous documents. His request #3, which remains outstanding, is as follows: 3. For the time period of January 1, 2020 through the time of your response to this request, all charts, graphs, statistical compilations, letters, memos and other records showing, discussing, or describing the nature and/or number of Grafton student related complaints filed with your office, or any Grafton School principal's office, alleging marginalization, discrimination, bullying, or harassment by other students, teachers, or administrators within the Grafton Public School System due in whole or in part to race or ethnicity … [including] … the student related complaints, if any. The School responded on August 6, 2021. Unsatisfied with the School’s response, Attorney Jansen appealed, and this appeal, SPR21/2008, was opened as a result. Based upon a communication between a Public Records Division staff attorney and a School representative, it is my understanding that the School intends on providing a subsequent response to Attorney Jansen. Accordingly, the School is ordered to provide Attorney Jansen with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Jansen may appeal the substantive nature of the School's response within ninety days.
