Murray Supervisor of Records August 25, 2021 SPR21/2039 Titi Siriphan City Clerk City of Gardner 115 Pleasant Street, Room 201 Gardner, MA 02571 Dear Ms. Siriphan: I have received the petition of Paul DeMeo appealing the response of the City of Gardner (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 31, 2021, Mr. DeMeo requested, “…all correspondence between you and [named person] between the dates of January 1st, 2021 and July 31st, 2021. This request is to include all texts, e- mails, letters and any other communication or correspondence with said official.” On August 13, 2021, the City responded. Unsatisfied with the City’s response, Mr. DeMeo petitioned, this office and this appeal, SPR21/2039, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. DeMeo to address his concerns. Accordingly, the City is ordered to provide Mr. DeMeo with a response to his request in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. DeMeo may appeal the substantive nature of the City’s response within ninety days.
