Dahill Town Clerk Town of Carver 108 Main Street Carver, MA 02330 Dear Ms. Dahill: I have received the petition of Mary Dormer appealing a response from the Town of Carver to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). In her August 17, 2021 petition for this appeal, Ms. Dormer states, “[m]y requests for information remain unfulfilled.” Requirements for filing an appeal In an effort to clarify the request for records, and whether Ms. Dormer is appealing a specific response from the Town, this office contacted Mr. Dormer several times. Ms. Dormer has not provided the necessary documents for this appeal. Therefore, it is unclear what the basis of Ms. Dormer’s appeal is. Ms. Dormer did not provide this office with a copy of her original request, nor did she provide this office with the Town’s response to the original request that she seeks an appeal for. Ms. Dormer is advised in petitioning the Supervisor for an appeal, the requestor must provide: a copy of the response received from the records access officer, a complete copy of the letter by which the request was made, including in the case of electronic communications all header information indicating time, date, subject, sender and recipient email addresses. See 950 C.M.R. 32.08(l)(g)(l). In addition, in petitioning the Supervisor, the requestor shall provide a copy of such petition to the records access officer associated with such petition. See 950 C.M.R. 32.08(1)(h). Ms. Dormer may file a new appeal once she has gathered the original request and the specific response to the original request in filing her petition. However be aware, that all petitions for appeal of a response by a records access officer must be made within 90 calendar days of the date of the response by a records access officer.
