Murray Supervisor of Records August 31, 2021 SPR21/2088 Helene Bettencourt Primary Records Access Officer Department of Elementary & Secondary Education 75 Pleasant Street Malden, MA 02148 Dear Ms. Bettencourt: I have received the petition of Gerry Mroz, appealing the response of the Department of Elementary & Secondary Education (Department/DESE) to a request for public records. G. L. c. 66, § l0A; see also 950 C.M.R. 32.08(1). On July 22, 2021, Mr. Mroz requested the following records: 1. The Report submitted by the Gifted and Talented Education Advisory Council at the end of June, 2021 2. The FY21 contract(s) between DESE and the Center for Talent Development (CTD) at Northwestern University 3. The FY22 contract(s) between DESE and the Center for Talent Development (CTD) at Northwestern University 4. The FY21 contract(s) between DESE and Ed Inquiry, LLC 5. The FY22 contract(s) between DESE and Ed Inquiry, LLC 6. The link to the virtual storage drive used by the Gifted and Talented Education Advisory Council, with links to retrieve all materials/files/records used by the Council since March, 2020. On August 2, 2021, the Department responded and produced an additional response on August 6, 2021. Unsatisfied with the Department’s responses, Mr. Mroz petitioned this office and this appeal, SPR21/2088, was opened as a result. Subsequently, I learned that the Department responded to Mr. Mroz’s request with a response sent on August 25, 2021. Where this appeal was opened as a result of the Department’s August 2nd and August 6th responses, I will now consider this administrative appeal closed. Mr. Mroz may appeal the substantive nature of the Department’s August 25th response within ninety days. See 950 C.M.R. 32.08(1).
