Palmer Super Records Access Officer City of Framingham 150 Concord Street; Room B-37 Framingham, MA 01702 Dear Mr. Palmer: I have received the petition of Olufunmilola Shelly appealing the response of the City of Framingham (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 5, 2021, Ms. Shelly requested, “… all emails sent or received by any of the following people…between 1/1/2021 and 8/5/2021, when a sender or recipient has an email address on the domain/email suffix of @dor.state.ma.us [including] [a]ll attachments.” On August 19, 2021, the City responded. Unsatisfied with the City’s response, Ms. Shelly petitioned this office and this appeal, SPR21/2123, was opened as result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Ms. Shelly. Accordingly, the City is ordered to provide Ms. Shelly with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Shelly may appeal the substantive nature of the City’s response within ninety days.
