Cullen Legislative Liaison Massachusetts Military Division 2 Randolph Road Bldg. 1505 Hanscom AFB MA 01731-3001 Dear Mr. Cullen: I have received the petition of Andrew Gottlieb, of the Association to Preserve Cape Cod, appealing the response of the Massachusetts National Guard (National Guard) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On June 30, 2021 and July 20, 2021, Mr. Gottlieb requested the following: [1] All documents, including, but not limited to, e-mails and letters relating to the proposed Joint Base Cape Cod Multi-Purpose Machine Gun Range sent by [named individual] to members of the Massachusetts Congressional Delegation, Massachusetts Constitutional Elected Officials, and Cape Cod municipal and county elected officials including, but not limited to, [15 named individuals] [2] All documents, including, but not limited to, e-mails and letters relating in any manner to any aspect of the proposed Joint Base Cape Cod Multi-Purpose Machine Gun Range sent by [named individual] to any and all current or former staff in the District and/or Washington D.C. offices of the members of the Massachusetts Congressional Delegation, current or former staff in the offices of Massachusetts Constitutional Elected Officials, and current or former staff in the offices of Barnstable County, Massachusetts, elected officials including, but not limited to, current or former staff of the following persons . . .” The National Guard provided responses on July 15, 2021 and August 4, 2021, which included responsive records. Claiming to not have received all the responsive records, Mr. Gottlieb petitioned this office and this appeal, SPR21/2133, was opened as a result. In an email dated September 7, 2021, this office was notified that the National Guard provided Mr. Gottlieb with a supplemental response on September 7, 2021.
