LaVallee, Esq. of Raipher, PC appealing the response of the Hampden Sheriff’s Office (Office) to her request for public records. G. L. c. 66, §10A; see also 950 C.M.R. 32.08(1). On May 24, 2021, Attorney LaValee requested the following records: [1] Any and all records, reports, and investigation notes concerning allegations of sexual assault by corrections officers and/or HCSD staff/personnel from 2010- present. [2] Any and all records, reports, and investigation notes concerning allegations of sexual assault made by inmates against corrections officers and/or HCSD staff/ personnel from 2010-present. [3] Any and all complaints filed with the HCSD concerning allegations of sexual assault at HCSD facilities, including sexual assaults involving inmates, correctional officers and/or HCSD staff/personnel from 2010-present. [4] Any and all witness statements for sexual assault allegations, including sexual assaults involving inmates, correctional officers, and/or at HCSD facilities from 2010-present. [5] Any and all photographs, videos, audiotapes, CDs, DVDs, and/or other media concerning sexual assaults and investigations of sexual assaults at HCSD facilities, including sexual assaults. [6] Any and all investigative guidebooks and/or handbooks for the HCSD concerning the investigation of sexual assaults at HCSD facilities from 2010- present. [7] The total number of complaints of sexual assaults that resulted in investigation at the HCSD from 2010 to the present. The Office responded on June 7, 2021. Unsatisfied with the response, Attorney LaValee appealed and SPR21/2188 was opened as a result. Subsequently, I learned that the Office responded to Attorney LaValee’s request with a response sent on September 9, 2021. Where the basis of this appeal was opened as a result of the Office’s June 7th response, I will now consider this administrative appeal closed.
