Assistant General Counsel Suffolk County Sheriff’s Department 200 Nashua Street Boston, MA 02114 Dear Attorney Romero: I have received the petition of Julian Troche appealing the nonresponse of the Suffolk County Sheriff’s Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 28, 2021, Mr. Troche requested the following records: 1.) Any and all records relatin[g] to cell phone extractions from [an identified cell phone number], meaning [a]ffidavit for warrants and any granted warrants for the phone number listed above, mainly for text messages[, and;] 2.) Any and all records relating to the search of [an identified motor vehicle] registered to [an identified individual], that includes affidavit for warrant and warrant itself. Claiming to not yet have received a response, Mr. Troche petitioned this office and this appeal, SPR21/2198, was opened as a result. Subsequently, I learned that the Department intends on providing a written response to Mr. Troche. Accordingly, the Department is ordered to provide Mr. Troche with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Troche may appeal the substantive nature of the Department’s response within ninety days.
