Murray Supervisor of Records September 14, 2021 SPR21/2209 Helene Bettencourt Associate Commissioner Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148-4906 Dear Ms. Bettencourt: I have received the petition of Michael DiPronio appealing the response of the Department of Elementary and Secondary Education (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 11, 2021, Mr. DiPronio requested, “copies of the latest Special Education Program Plan Statements” from a number of school districts. Prior Appeals The requested records were the subject of prior appeals. See SPR21/1894 Determination of the Supervisor of Records (August 6, 2021). See SPR21/2018 Determination of the Supervisor of Records (August 24, 2021). In my August 24th determination I ordered the Department to clarify whether additional records exist. On August 24th the Department responded. Unsatisfied with the Department’s response, Mr. DiPronio petitioned this office and this appeal, SPR21/2209, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. DiPronio. Accordingly, the Department is ordered to provide Mr. DiPronio, with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. DiPronio may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
