Box 426 Tisbury, MA 02568 Dear Chief Habekost: I have received the petition of Rich Saltzberg of Martha’s Vineyard Times appealing the nonresponse of the Town of Tisbury Police Department (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 30, 2021, Mr. Saltzberg requested “all reports, memos, emails, or other records pertaining to a missing Department’s firearm previously issued to former officer [named individual].” Claiming to not yet have received responsive records, Mr. Saltzberg petitioned this office and this appeal, SPR21/2351, was opened as a result. It is my understanding the Department provided a response dated September 14, 2021 to Mr. Saltzberg’s request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Saltzberg may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
