Dahill Town Clerk Carver Town Hall 108 Main Street Carver, MA 02330 Dear Ms. Dahill: I have received the petition of Mary Dormer appealing the response of the Town of Carver (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 31, 2021, Ms. Dormer requested, “…all email messages from the Carver Select Board during the 2019-2020 year and any and all candidates for the Interim Town Administrator Position following the departure of [named person].” On September 13, 2021, the Town responded. Unsatisfied with the Town’s response, Ms. Dormer petitioned this office and this appeal, SPR21/2369, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Ms. Dormer. Accordingly, the Town is ordered to provide Ms. Dormer with a response to the request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Dormer may appeal the substantive nature of the Town's response within ninety days.
