Murray Supervisor of Records September 27, 2021 SPR21/2376 Lisa Presby Program Director Office of the City Solicitor City of New Bedford 133 William Street, Room 203 New Bedford, MA 02740 Dear Ms. Presby: I have received the petition of Will Sennott appealing the response of the City of New Bedford Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 23, 2021, Mr. Sennot requested, “…All service calls to middle schools and high schools in the New Bedford School District. This information should describe the location and reason for the service call (e.g. theft, vandalism, etc.). It should also include the interaction or result of the service call (e.g. arrest, summons, etc.). We are requesting those numbers for the academic years: 2016-2017, 2017-2018, 2018-2019 and 2019-2020 and 2020-2021.” On September 7, 2021, the Department responded. Unsatisfied with the Department’s response, Mr. Sennot petitioned this office and this appeal, SPR21/2376, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. Sennot. Accordingly, the Department is ordered to provide Mr. Sennot with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Sennot may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
