Cullen Primary Records Access Officer Massachusetts National Guard Headquarters 2 Randolph Road Hanscom, MA 01731 Dear Mr. Cullen: I have received the petition of Peter Contos appealing the nonresponse of the Massachusetts National Guard (Guard) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 29, 2021, Mr. Contos requested numerous records related to a particular date in 1997 related to a particular group of personnel. Claiming to not yet have received a response, Mr. Contos petitioned this office and this appeal, SPR21/2417, was opened as a result. Subsequently, I learned that the Guard is processing the relevant documents and intends to provide Mr. Contos with a response to his request as soon as confirmation is complete. Accordingly, I will now consider this administrative appeal closed. Mr. Contos may appeal the substantive nature of the Guard’s response within ninety days. See 950 C.M.R. 32.08(1).
