Assistant District Attorney Records Access Officer Norfolk County District Attorney’s Office 45 Shawmut Road Canton, MA 02021 Dear Attorney Monahan: I have received the petition of Laura Crimaldi of the Boston Globe appealing the response of the Norfolk County District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 21, 2021, Ms. Crimaldi requested, “…copy of any and all records, including e-mails and text messages, that make mention of a report Milton Academy announced in 2017 about sexual abuse of minor students…” The Office responded on August 4, 2021. Unsatisfied with the Office's response, Ms. Crimaldi petitioned this office and this appeal, SPR21/2442, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and an Office representative, it is my understanding that the requested records relate to pending litigation, Commonwealth v. Reynold Buono, Norfolk Superior Court, Docket No. 1782CR00399. Pending litigation 950 C.M.R. 32.08(2)(b) provides in pertinent part: the Supervisor may deny an appeal for, among other reasons if, in the opinion of the Supervisor: 1. the public records in question are the subjects of disputes in active litigation, administrative hearings or mediation. In light of the pending litigation, I decline to opine on this matter at this time. See 950 C.M.R. 32.08(2)(b). It should be noted that a change in the status of this action could impact the applicability of 950 C.M.R. 32.08(2)(b).
