Murray Supervisor of Records October 12, 2021 SPR21/2471 Seah Levy Public Records Access Officer City of Cambridge – Law Department Cambridge City Hall 795 Massachusetts Avenue Cambridge, MA 02139 Dear Ms. Levy: I have received the petition of Jack Hembrough appealing the response of the City of Cambridge Law Department (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 9, 2021, Mr. Hembrough requested a certain motor vehicle accident report. Claiming to not yet have received responsive records, Mr. Hembrough petitioned this office and this appeal, SPR21/2471, was opened as a result. Current Appeal On July 23, 2021, the City informed Mr. Hembrough, “[t]he District Attorney’s Office has closed this investigation. Can I [City] get a better idea of which reports you need…Many of the reports on this incident will involve medical and personal information, and need to be redacted.” Mr. Hembrough provided additional information to the City on July 23rd. Conclusion However, it remains unclear whether the City has provided a response. As such, the City is ordered to provide Mr. Hembrough with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Hembrough may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
