G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On August 16, 2021, Ms. Butler requested “all ‘2021 renewal of Private Restricted Landing Area (PRLA)’ for the Town of Mashpee.” The Department responded on September 2, 2021, indicating it would require additional time to complete a search of the records. Having received no further response, Ms. Butler appealed, and this case was opened as a result. Subsequently, I learned that the Department responded to Ms. Butler’s request by mail on September 28, 2021. Where this matter was opened based upon the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Butler may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
