Mazzola Executive Administrative Assistant Newton Public Schools 100 Walnut Street Newton, MA 02460 Dear Ms. Mazzola: I have received the petition of Jonathan Levin appealing the response of the Newton Public Schools (School) to a request for public records. G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On August 31, 2021, Mr. Levin requested, “[a]ll records pertaining to development and implementation of the NPS Statement of Values & Commitment of Equity, including, but not limited to: names of each individual and organization who participated; contracts for any third‐ party organization who participated; meeting dates, attendees, notes and vote results with respect to same.” The School provided responses on September 20, 2021; September 27, 2021; and September 28, 2021. Unsatisfied with the School’s responses, Mr. Levin petitioned this office and this appeal, SPR21/2507, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a School representative, it is my understanding that the School intends on providing a subsequent response to Mr. Levin. Accordingly, the School is ordered to provide Mr. Levin with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Levin may appeal the substantive nature of the School’s response within ninety days.
