Staples, Esq. Office of the Chief Legal Counsel Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Staples: I have received a petition from Colman Herman appealing the response of the Department of State Police (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 3, 2021, Mr. Herman requested, “…copies of any and all internal affairs reports that deal with state troopers improperly accessing citizen records, including, but not limited to, Criminal Offender Record Information (CORI) records …for the period January 1, 2015 to the present.” The Department responded on September 23, 2021. Unsatisfied with the response, Mr. Herman petitioned this office and this appeal, SPR21/2517, was opened as a result. Subsequently, I learned that the Department provided a response on September 30, 2021. Where the basis of this appeal was opened as a result of the of the Department’s September 23rd response, I will now consider this administrative appeal closed. Mr. Herman may appeal the substantive nature of the Department's September 30th response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
