The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records October 8, 2021 SPR21/2581 Michael Tencellent, Esq. Records Access Officer Department of Conservation and Recreation 251 Causeway Street Boston, MA 02114 Dear Attorney Tencellent: I have received the petition of Christopher Burrell of WGBH appealing the nonresponse of the Department of Conservation and Recreation (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 15, 2021, Mr. Burrell requested “documents showing the time each daily test was conducted between August 15, 2021 and September 15, 2021 at four (4) marine sites along Kings Beach in Lynn.” Claiming to not yet have received responsive records, Mr. Burrell petitioned this office and this appeal, SPR21/2581, was opened as a result. It is my understanding the Department provided a response dated October 5, 2021 to Mr. Burrell’s request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will consider this administrative appeal closed. Mr. Burrell may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, .fJ A ~ ~ ~ - ~0 1WJ«C(J. . - . Rebecca S.
