Murray Supervisor of Records October 14, 2021 SPR21/2639 Scott Lambiase Town Manager Town of Abington 500 Gliniewicz Way Abington, MA 02351 Dear Mr. Lambiase: I have received the petition of Karen Bowen appealing the response of the Town of Abington (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 21, 2021, Ms. Bowen requested: 1) All records regarding the Complaint filed by [named person] on August 13, 2021. This will include all correspondence between or among town officials (appointed or elected) regarding the dismissal of Abington Conservation Commission members [named persons] and the suspension of [named person].I am asking that any and all documentation, including but not exclusive to, interview summaries, memos, letters, town counsel opinions, and more, from both before and after the Board of Selection meeting of August 23, 2021. 2) This request includes all email correspondence between all town officials (appointed or elected) relating to this matter. The draft and published meeting notes of the Board of Selectmen August 24, 2021 meeting is also included in this request. On October 5, 2021, the Town responded. Unsatisfied with the Town’s response, Ms. Bowen petitioned this office and this appeal, SPR21/2639, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Ms. Bowen. Accordingly, the Town is ordered to provide Ms. Bowen with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Bowen may appeal the substantive nature of the Town's response within ninety days.
