Counsel to the Commissioner Litigation Bureau Massachusetts Department of Revenue 100 Cambridge Street, 7th Floor Boston, MA 02114-9565 Dear Attorney Randall: I have received the petition of Edward J. DeWitt appealing the response of the Department of Revenue (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 30, 2021, Mr. DeWitt requested, “… records relevant to the collection of Ferry Embarkation Fees in accordance with the Department Technical Information Release (TIR) 04-18 for the Town of Falmouth [and] … the ferry operators (names) and the amount collected/paid from 2005 until the present.” The Department responded on October 1, 2021 and October 4, 2021. Unsatisfied with the response, Mr. DeWitt petitioned this office and this appeal, SPR21/2655, was opened as a result. Subsequently, I learned that the Department provided a supplemental response on October 15, 2021. Where the basis of this appeal was opened as a result of the of the Department’s October 1st and October 4th responses, I will now consider this administrative appeal closed. Mr. DeWitt may appeal the substantive nature of the Department's response within ninety days. See 950 C.M.R. 32.08(1).
