Dahill Town Clerk Town of Carver Town Hall 108 Main Street Carver, MA 02330 Dear Ms. Dahill: I have received the petitions of Mary Dormer appealing the response of the Town of Carver (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 5, 2021, Ms. Dormer requested, “…cell phone transcripts of the public meeting on October 5, 2021 where I witnessed [named persons] texting … from 5 p.m. to the end of the school committee meeting [and] cell phone transcripts of any person involved in the public meetings held on October 5, 2021.” On October 12 and October 13, 2021, the Town responded. Unsatisfied with the Town’s responses, Ms. Dormer petitioned this office and these appeals, SPR21/2687 and SPR21/2688, were opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding the Town intends on providing a subsequent response to Ms. Dormer. Accordingly, the Town is ordered to provide Ms. Dormer with a response to her requests in a manner consistent with the Public Records Law and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Dormer may appeal the substantive nature of the Town’s response within ninety (90) days.
