Murray Supervisor of Records November 5, 2021 SPR21/2764 Maureen McKeon Department RAO City Council Department City of Framingham 150 Concord St. Framingham, MA 0170 Dear Ms. McKeon: I have received the petition of Brian Petrini-Smith appealing the response of the City of Framingham City Council Department (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 7, 2021, Mr. Petrini-Smith requested, “all emails sent or received by [named person]…between 09/15/2021-10/07/2021…all texts, emails from [named person’s] personal cell phone and personal email…between 09/15/2021-10/07/2021…a screenshot of [named person’s] cell phone call log.” On October 21, 2021, the City responded. Unsatisfied with the City’s response Mr. Petrini-Smith petitioned this office and this appeal, SPR21/2764, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Petrini-Smith. Accordingly, the City is ordered to provide Mr. Petrini-Smith with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Petrini-Smith may appeal the substantive nature of the City’s response within ninety days.
