G. L. c. 66, §10A; see also 950 C.M.R. 32.08(1). On July 6, 2021, Mr. Jaffe requested ten years of internal affairs records. Subsequently, the request was modified for internal affairs records from January 1, 2020 to December 31, 2020. Previous appeals This request was the subject of previous appeals. See SPR21/1744 Determination of the Supervisor of Records (July 20, 2021); and SPR21/1884 Determination of the Supervisor of Records (August 3, 2021). The Department responded on October 19, 2021. In its October 19, 2021 response, the Department stated that it “… will need approximately 8 hours total to comply with this request. The Department acknowledges that it may not assess a fee for the first two hours. As a result of this, the fee estimate would be based on 6 hours [and] reasonable cost estimate will be roughly $150.00.” Unsatisfied with the Department’s response, Mr. Jaffe petitioned this office and this appeal, SPR21/2816, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. Jaffe. Accordingly, the Department is ordered to provide Mr. Jaffe with a response to his request in a manner consistent with the Public Records Law and its Access Regulations as soon as is practicable. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Jaffe may appeal the substantive nature of the Department's response within ninety days.
