General Counsel Alcoholic Beverages Control Commission 95 Fourth Street, Suite 3 Chelsea, Massachusetts 02150 Dear Attorney Foster: I have received your petition on behalf of the Alcoholic Beverages Control Commission (ABCC) seeking an extension of time to produce records. G. L. c. 66, § 10(c); G. L. c. 66, § 10(d)(iv). As required by law, it is my understanding that the ABCC furnished a copy of this petition to the requestor, Attorney Leon Nowicki. Id. In a letter dated September 27, 2021, Attorney Nowicki requested “46 licensee files of retail alcohol licensees” on behalf of his client. On October 26, 2021, the ABCC submitted a time petition to this office requesting “that the Public Records Division grant the ABCC twenty (20) additional business days from its initial deadline to complete a public records request pursuant to M.G. L. c. 66, § 10(c), This request is to extend the deadline for the ABCC’s response from November 3, 2021, to December 3, 2021.” In an email on November 1, 2021, the ABCC stated, “[t]he ABCC would like to withdraw its request for additional time to respond to Mr. Nowicki’s public records request. The ABCC was able to provide Mr. Nowicki with his entire request last week.” Conclusion Based on the ABCC’s production of records and withdrawal of its petition, I find it is unnecessary to opine on this matter.
