Ugolini appealing the response of the Office of the District Attorney, Hampden District (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 31, 2021, Attorney Ugolini requested “to inspect and copy any and all documents in the possession of the Hampden County District Attorney’s office concerning [a certain] captioned matter.” He specified that he is “not seeking to inspect and copy the victims’ medical records.” This request was the subject of a previous appeal. See SPR21/2716 Supervisor of Records Determination (October 29, 2021). In my October 29th determination, I ordered the Office to clarify how each cited exemption applies to each record being withheld or redacted, and to demonstrate whether the Office had followed proper records retention protocol. Subsequently, the Office provided a written response on November 3, 2021. Unsatisfied with the Office’s response, Attorney Ugolini appealed, and this case was opened as a result. Based on a phone conversation between this office and an attorney for the Office on November 17, 2021, I understand that the Office intends to provide a supplemental response. Accordingly, said response must be provided to Attorney Ugolini in a manner consistent with the Public Records Law and its regulations within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. If issues remain unresolved, Attorney Ugolini may appeal the substantive nature of the Office’s supplemental response within ninety days. See 950 C.M.R. 32.08(1).
