Assistant City Solicitor City of Lynn 3 City Hall Square, Room 406 Lynn, MA 01901 Dear Attorney Lamanna: I have received the petition of Laura Gallant, Esq. appealing the response of the City of Lynn (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On July 9, 2021, Attorney Gallant requested: “[a]ll communications, including but not limited to communications in e-mail, text, and paper form, regarding or referring to the ‘Housing Lynn’ Housing Production Plan, sent and/or received by any city department or employee, including but not limited to members of the Lynn City Council, Lynn Housing Authority and Neighborhood Development (LHAND), Economic Development Industrial Corporation (Lynn EDIC), Lynn Water & Sewer Commission and Lynn Public Schools Department, during the period January 1, 2021 to the current date.” Prior Appeal The requested records were the subject of a prior appeal. See SPR21/2439 Determination of the Supervisor of Records (October 7, 2021). In my October 7th determination, I found that the City intended on providing a supplemental response to Attorney Gallant. On October 25, 2021, the City responded. Unsatisfied with the City’s response, Attorney Gallant petitioned this office and this appeal, SPR21/2946, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Attorney Gallant. Accordingly, the City is ordered to provide Attorney Gallant with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Gallant may appeal the substantive nature of the City’s response within ninety days.
