Murray Supervisor of Records November 15, 2021 SPR21/2962 Helene Bettencourt Primary Records Access Officer Department of Elementary and Secondary Education 75 Pleasant Street Malden, MA 02148-4906 Dear Ms. Bettencourt: I have received the petition of Michael DiPronio appealing the nonresponse of the Department of Elementary and Secondary Education (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 19, 2021, Mr. DiPronio requested “[a]ll special education program plan statements (SEPPS) filed by the following districts between October 1, 2016 and October 1, 2021…” Claiming to not yet have received responsive records, Mr. DiPronio petitioned this office and this appeal, SPR21/2962, was opened as a result. It is my understanding the Department provided a response dated November 9, 2021 to Mr. DiPronio’s request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will consider this administrative appeal closed. Mr. DiPronio may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
