G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On October 20, 2021, Mr. Tobin requested, “…a full export of the database (s) (sic) containing the 2019 MCAS results statewide only in the form in which it is regularly maintained.” On November 2, 2021, the Department responded. Unsatisfied with the Department’s response, Mr. Tobin petitioned this office and this appeal, SPR21/3010, was opened as a result. Subsequently, I learned that the Department responded to Mr. Tobin’s request with a further response sent on November 22, 2021. Whereas the basis of this appeal was opened as a result of the Department’s November 2nd response, I will now consider this administrative appeal closed. Mr. Tobin may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
