Murray Supervisor of Records December 9, 2021 SPR21/3112 Ellen Hartnett Town of Sherborn – Board of Health 19 Washington Street Sherborn, MA 01770 Dear Ms. Hartnett: I have received the petition of Bob Murchison appealing the response of the Sherborn Board of Health (Board) to a request for public records. G. L. c. 66 § 10A; see also 950 C.M.R. 32.08(1). On November 18, 2021, Mr. Murchison requested a copy of the notes taken at a specific meeting. The Board responded on November 24, 2021, providing the draft minutes of the November 17, 2021 meeting. Subsequently, Mr. Murchison clarified that he is looking for the handwritten notes, not the draft minutes. The Board responded on November 24, 2021, denying access to the responsive records pursuant to Exemption (e) of the Public Records Law. G. L. c. 4, § 7(26)(e). Unsatisfied with the Board’s response, Mr. Murchison petitioned this office and this appeal, SPR21/3112, was opened as a result. In an email correspondence dated December 9, 2021, this office was notified that a supplemental response was provided to Mr. Murchison. Accordingly, I will consider this administrative appeal closed. Mr. Murchison may appeal the substantive nature of the Board’s December 9th response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
