Hartnett Health Administrator Town of Sherborn – Board of Health 19 Washington Street Sherborn, MA 01770 Dear Ms. Hartnett: I have received the petition of Bob Murchison appealing the nonresponse of the Town of Sherborn – Board of Health (Town) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 5, 2021, Mr. Murchison requested “[a] copy of any transmittal of the request to town counsel…and copy of any reply that town counsel may make regarding [named individual] request…to interpret applicability of section III BOH regulations” for development of identified lots. Claiming to not yet have received responsive records, Mr. Murchison, petitioned this office and this appeal, SPR21/3144, was opened as a result. Subsequently, I learned that the Town responded to Mr. Murchison’s request with a response sent on December 9, 2021. Where the basis of this appeal was opened as a result of the Town’s lack of a written response, I will now consider this administrative appeal closed.
