Murray Supervisor of Records December 14, 2021 SPR21/3150 Eva Szkaradek Town Clerk Town of Acton 472 Main Street Acton, MA 01720 Dear Ms. Szkaradek: I have received the petition of Robert Hertz appealing the response of the Town of Acton (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On September 9, 2021, Mr. Hertz requested numerous records regarding diversity, equity, and inclusion initiatives. Prior appeal The responsive records was the subject of a prior appeal. See SPR21/2736 Determination of the Supervisor of Records (November 1, 2021). I closed my November 1st determination ordering the Town to provide a response in accordance with the order, the Public Records Law and its Regulations. On November 19, 2021, and November 22, 2021, the Town provided responses. Unsatisfied with the Town’s responses, Mr. Hertz petitioned this office and this appeal, SPR21/3150, was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Town representative, it is my understanding that the Town intends on providing a subsequent response to Mr. Hertz. Accordingly, the Town is ordered to provide Mr. Hertz with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Hertz may appeal the substantive nature of the Town's response within ninety days. See 950 C.M.R. 32.08(1).
